DMCA Copyright Policy

1. Overview

Eventrix respects the intellectual property rights of others and expects users to do the same. This Digital Millennium Copyright Act (DMCA) Policy outlines our procedures for addressing claims of copyright infringement.

In accordance with the DMCA (17 U.S.C. § 512), we will respond promptly to properly submitted notices of alleged copyright infringement.

2. Reporting Copyright Infringement

If you believe that content on our platform infringes your copyright, please send a written notice containing the following information to our designated DMCA Agent:

2.1 Required Information

1. Physical or electronic signature of the copyright owner or authorized agent

2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works)

3. Location of the infringing material (URL or other specific identification)

4. Your contact information: Name, address, telephone number, email address

5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law

6. A statement under penalty of perjury that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

3. Our Response to Notices

Upon receiving a valid DMCA notice, we will:

  • Review the notice for completeness and validity
  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material
  • Take appropriate action against repeat infringers

We aim to process valid notices within 24-48 hours of receipt.

4. Counter-Notification

If you believe that material you posted was removed in error or misidentification, you may submit a counter-notification containing:

1. Your physical or electronic signature

2. Identification of the removed material and its prior location

3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification

4. Your name, address, phone number, and email

5. Consent to jurisdiction of the Federal District Court for your judicial district (or Austin, TX if outside the U.S.) and that you will accept service of process from the complainant

Send counter-notifications to the same DMCA Agent address listed above with the subject line "DMCA Counter-Notification".

What Happens Next

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed material.

5. Repeat Infringer Policy

We maintain a policy of terminating accounts of users who repeatedly infringe copyrights. Repeat infringers are determined on a case-by-case basis and may include users who:

  • Have received multiple valid DMCA notices
  • Have had multiple pieces of content removed
  • Have failed to respond to warnings

6. False Claims

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney fees. Do not make false claims.

7. Content Guidelines for Users

To avoid copyright issues:

  • Only upload content you created or have permission to use
  • Respect photographer, videographer, and designer copyrights
  • Obtain proper licenses for music, images, and videos
  • Give credit where required
  • When in doubt, don't upload it

8. Fair Use

Fair use is a legal doctrine that permits limited use of copyrighted material without permission for purposes such as criticism, commentary, news reporting, teaching, or research. Whether a use qualifies as fair use depends on multiple factors, including:

  • Purpose and character of the use
  • Nature of the copyrighted work
  • Amount used relative to the whole work
  • Effect on the market for the original work
